Cops won't take his report

From the NY Post:

A Queens man who claims his signature was forged on an auto-financing agreement that grossly inflated his agreed-upon monthly payments says the NYPD has repeatedly refused to take a complaint about the alleged crimes.

"Each time I brought it to them, they said, ‘No,’" said Andrew Burrowes, 33, about the four times he has tried to file criminal complaints in connection with his SUV purchase from Auto Palace in Woodside.

“They said that didn’t constitute a police report,” said Burrowes, a school-bus driver. Adding to Burrowes’ frustration is that the auto lender, Ally Financial, has asked him to provide a police report to help resolve the situation -- in which he said a forged document jacked up his loan amount for a 2004 Volvo.

The allegedly false loan papers said he agreed to buy the vehicle for $26,645 -- not the $13,900 to which he said he’d agreed.

good for this guy for making this public. He was victimized twice - once by Auto Palace - and then again by the NYPD.

Tell him to call the NYS Attorney General. They have an interest in predatory car dealers and have civil actions pending against some. They may be able to apply some pressure to the dealer to get him to renegotiate loan,

Also he should file an identity theft claim with the Federal Trade Commission. They won't help him renegotiate the loan, but at least the complaint is on record.

As another anonymous complainant stated, this is something for the Queens DA or the NYS Attorney General.

NYPD would classify this as a civil matter, a he-said-she-said issue.

@IrishNYC: I don't believe that you aren't motivated in your disbelief by the color of the man's skin. What basis for belief/disbelief do you have, anyhow. A police report is a written complaint, not a verdict or even a finding of fact.

It's not the responding cops place to determine whether this guy is worthy of receiving a report. I too thought this would simply be a civil matter, but there is some crime involved if this is in fact what occurred.

"An NYPD spokesman said a 114th Precinct supervisor had no knowledge of Burrowes visiting there, but added that the NYPD encouraged him to return to that precinct house, where “they absolutely will take a report.’’

Obviously they should have taken a report in this case.

What is the dealer or finance company doing selling it to him?
Sounds like scammer vs scammer. The police should still take the report. It is not their place to decide whose reports to take and whose not to.

Joe, the cop who sprayed the mace was a higher ranking officer in a white shirt, and he definitely looked like he could have been Irish (not that it matters). There are other videos of this incident from other angles as well.

Crappy, this is a story you should be covering, even though it's not a Queens story. Whether or not you care about or agree with the views of the protesters, the fact that the NYPD actively suppresses non violent protests (this is not the only one) in what is supposed to be one of the great cities in the free world, is disturbing to say the least. The fact that the mainstream media is downplaying these protests is no coincidence, as out dictator mayor has a TREMENDOUS influence on the media because of his own media company.
Think about it, if people were out protesting against political corruption on the local level and expressing their disgust for tweeding and over development, their protests would just as likely stifled by and be met with abuse by the NYPD.

We are free...to do as they tell us.

This sounds like that guy in Flushing (can't remember his name) who said somebody filed a phony mortgage on his house and wouldn't take 'no' for an answer as the legal system tried to slough him off and then he ended up dead.

I'd guess a bunch of cops have invested in that car dealership or something like that.

Things have gotten really bad in New York City for average system with no 'connections'.

Interesting. It would appear the market value of a 2004 Volvo XC90 is much closer to the price this gentleman is claiming...the top of the line w/ low miles and excellent condition bluebooks less than 17k...

Also the Police are quoted in the article saying they were unaware and would file a report if he contacted them.

As for the Wall Street protests, they may have been non-violent, but they were illegal. Don't see the point in making heroes out of people who have no regard for public safety.

New York State accepts complaints about new car dealers. Before filing a complaint, you should attempt to settle the matter directly with the dealer.

Used car dealers are required by law to provide you with a written statement that the car you are purchasing is a salvage vehicle. Used car dealers must also provide you with a bill of sale that includes the name and address of the business, the price of the car, the cost for any added-on items, totals and sub-totals, sales tax amount, and a "Notice to Buyer" stating that the car has passed inspection and is fit to drive.

Used car dealerships may not park their cars on public streets and sidewalks.

I don;t think this guy would take his issue public if it were a scam. Thus give him an opportunity to file a complaint / report as he needs to do to resolve his issue - at that point the professionals at the Police Dept can determine if the issue is potentially a fraudulent matter that the DA is called to address by indictment or Grand Jury.

No, your problem here is compstat. The pressure to get rid of certain felonies comes from the very top- the mayor and the police commissioner. Failing that, IMPACT rookies are encouraged to arrest anyone with one molecule of marijuana on them (even if you have to do a bad search to get it- gotta brown-nose the bosses for a nice non-patrol detail)so pct C.O.s can show cells filled with perps as an answer to a rising crime problem. Police work these days is all about looking like you're doing something even if it doesn't work and bringing in lotsa arrests and tickets.
