Maspeth developer shut down by DOB, runs to BSA


From the Queens Gazette:

The next monthly meeting of Community Board 5 (CB5) will be conducted on December 14 at 7 p.m. in the cafeteria of Christ the King Regional H.S., 68-02 Metropolitan Ave., Middle Village. The agenda includes a public hearing regarding BSA Cal. #173-11-A, for property at 68-10 58th Ave., Maspeth. This is an application to the city Board of Standards and Appeals seeking a determination that the owner of said property has a vested right to complete construction and obtain a Certificate of Occupancy for a proposed three-story alteration (enlargement) to an existing mixed-use building at this location. (Block: 2777; Lot:11).

Let me translate: If DOB catches you building something they didn't authorize, you can just run to BSA and they'll help you out. Didn't follow the architectural plans? No parking? Have outstanding violations? No problem!

Its DOB permit hasn't been revoked and the stop work was lifted on 02/28/2008. The job's even never been audited by DOB. This project goes to BSA maybe for some other reasons.

You don't argue that you have a "vested right to complete construction and obtain a C of O" for the 3 story enlargement you built unless the DOB found an issue with it. Just because the complaint does not appear online doesn't mean there isn't a problem.

Here on Staten Island we had one o these travesty audited. DoB assigned it to the same plan examiner who originally approved the plans. Guess what? It passed audit. duh. Since then the complaints for non-compliance have mounted (for example, a variance saying they were working on aBJ's Wholesale club (it's a proposed wharehouse) and that work is not taking place within 200 feet of a residence (right across the 50' street, which is, btw, zoned R2 - abutting an M3-1: we share your pain, Queens!). No parking, and we're facing 53' trucks mzking deliveries - did I mention the 50' wide street? Feh.

Actually, Oriental and Occidental are directional terms, nothing more.

Orient means from the east and Occident means from the west.

Tear it down. It's an eyesore. If the BSA allows them to finish(which they will because they are in bed together), force the developer to make the construction accommodate Senior Housing. With high rents, seniors are struggling. Force the developers to deliver these structures to seniors.

I think I would rather have this completed than looking at it the way it is...messy and abandoned. It has been like this for so long.

How much does it cost to run the bsa a year? That money could be put to much better use.
