Idling construction vehicles in the middle of the night in Flushing



Mr. Patel,

Senator Liu's Facebook staff told me to reach out to you regarding idling construction vehicles at 36-23 172 St. Friday, August 9 it began at 5:00 AM and went on for the rest of the day. Today, Monday, August 12 it began at 2:00 AM and has continued since.

At 2:00 this morning 2 dump trucks parked on 172 Street between 39 Ave and Crocheron Ave and idled on and off until 7:00 AM when construction began at the above address. At one point one of the trucks idled for over 60 minutes. 

Attached are video and the license plate of the vehicle that was idling for 60 minutes.

Reports have been filed with 311 for idling vehicle noise and odor from idling vehicle, but these reports do no good when an inspector comes and the problem isn't occurring at that time.

I happened to run into the inspector from the DEP yesterday, and he assisted me with filing idling complaints for these vehicles. 

A Citizens Complaint has been filed for the incident on the morning of 8/12/19, report 2019-4534. As this happened again this morning, reports 2019-4540 and 2019-4534 have also been filed. While the above reports take care of the idling violation, these trucks also block private driveways and park in fire hydrants in addition to being noisy in the middle of the night.

Unsurprisingly, you never followed up on this complaint. Trucks continue to arrive to this site at all hours of the night: 12:30 AM, 2:00 AM, 4:00 AM. And now I find myself absolutely unable to enjoy my weekend because someone approved a Saturday work permit (permit 421679142). Trucks have been racing up and down 172 Street since 5:30 this morning, beeping, honking horns constantly, grinding their gears. Calls to 311 do nothing because they come days after the problem is gone, only for it to return again during the night.

This is not Manhattan. This is a quiet, residential street in Flushing; there is absolutely no need for approval of a Saturday work permit. None. Stop destroying neighborhoods and communities and do something about this.

Patel is State Senator John Liu's deputy chief of staff.

A Lot Merger form was filed with the Department of Finance, but they are also supposed to file an SI application to DOB.

AGAIN, why do you folks live in NYC? It is a shithole place to live on par with San Francisco, LA and Seattle. BUT NYC is the worst of all of them, well, maybe tied with San Fran.

Complaints have been filed with the DEP, awaiting court date.

Additionally, these trucks park every night, overnight. One in a hydrant, at least one in front of the construction site, and others wherever they can find space. Commercial vehicles are prohibited from parking on the streets overnight, and the 109 has been unhelpful or unwilling to do address it.

Not all of us can just get up and move!!! We live where we live but SHOULD NOT have to deal w this kind of noise at 2am!!!!! Horrible. And I'm shocked Paul Vallone hasn't commented on this problem. I thought as our City Councilman he would try to help us get rid of this problem. Especially this being in the vicinity of his own neighborhood.

Wrong, that was a quiet, residential street. The time to fight this sort of thing is when it's going through the permitting process, not afterward, and you can give up trying to do that living in NYC. There are no HOA's in the City (with good reason). Talk directly to the crew. Confront them in the morning, politely and firmly.

My neighbor bought his cousin a house across the street from his in our neck of the woods. He's simply gutted the inside and out and reclad it all with new materials, no expansion or upward construction. That is exceedingly rare, but it's because he doesn't want to ruin the quality of life for everyone else on our street, thankfully.

Unhappily, that is not the modus operandi of most people purchasing these kinds of homes. It's "tear down and crowd out" -- they know the weaker people will cut and run, and they get to do it again. and Again. AND AGAIN...

Amazing how the same cops who are happy to give us summons for nothing won't even give tickets to commercial vehicles flouting the law.

Flushing voted for Liu over Tony Avella so they got who they voted for. Tony Avella would have gotten personally involved and the story would have been in all the Queens weeklies. Sure a lot of Tony’s act was self promotion but Tony always got involved and put pressure on the responsible departments.

He has his sights set on QB Presidents office now, which allows Avella to possibly come back to the city council. The only silver lining I can think of. But I don't think it will happen for Avella though, because Avella would have to face an opponent AND the 'pop-up' NGO's similar to Justice Democrats that will try to destroy him. (It is getting increasingly hard to track these NGO's: case in point, the prostitution legalization "movement" that popped up in downtown Flushing recently.

It's a nightmare living near this. Now it seems it's time to rip open the streets, as this is all going on, for whatever project the city decided it's time for. No parking signs on Crocheron Avenue. Very bad planning. I don't know what they're carting off with these trucks, it's been non stop for weeks now, countless trucks daily. You would think they're building the twin towers here....
And how the hell does an ambulatory office fit in on the block? It's a residential block!
