NEW YORK (AP) -- A concrete manufacturer is accused of dumping waste into the heavily polluted Newtown Creek, which separates Brooklyn and Queens.
The environmental watchdog group Riverkeeper and New York City Councilman Eric Gioia said Thursday they've filed a notice of intent to sue NYCON Supply Corporation of Long Island City, Queens.
Newtown Creek is a 3-mile tributary of the East and Hudson rivers and New York Harbor, and the site of a decades-old oil spill from now-defunct refineries in Brooklyn's Greenpoint section.
Riverkeeper and Gioia say the company discharged liquid concrete, gravel, sand and other byproducts into the creek without a permit in violation of environmental laws including the Clean Water Act.
Plant manager George Reis says the company is declining comment while its lawyers review the papers.

Maybe NYCON can pave the creek over.
The waterway is not a Greenpoint waterway. It runs along LIC, Maspeth, Williamsburg and Greenpoint. In the recently completed FED report it clearly states that the most polluted part of the creek is the southern section in Williamsburg not Greenpoint.
it's all relative. No one is swimming in ANY part of it.
There is more oil under that creek than in the Arctic National Wildlife Preserve.
Figure out a way to get the oil out and pave the whole thing into a walking park.
they overfill their trucks and dump it on skillman ave all the time. they are the only ones around that area. they don't care and neither do their drivers!!!!
