Toby wants Hiram out

Expel Senator Monserrate

When I was appointed to the Select Committee to investigate the facts surrounding Senator Hiram Monserrate’s conduct the night of December 19, 2008, I promised to keep an open mind. After countless hours of reading testimony, watching presentations and videotapes, and attending meetings, I am convinced that the inquiry was thorough, transparent, fair and bipartisan.

After a careful review of the information presented to the Committee, I came to the conclusion that his behavior merited severe sanctions. I repeatedly watched the surveillance video of his building which showed him dragging Ms. Giraldo through the halls. The assault on Ms. Giraldo was clearly one of domestic violence. We must enforce our “zero tolerance” policy concerning domestic violence.

Senator Monserrate failed to cooperate with the Committee. His supporters gave conflicting, inconsistent versions of events. In what seemed to be more concern about his political future than his victim’s well being, he chose to drive her to a distant hospital, Long Island Jewish, instead of Elmhurst – a five minute walk. He failed to accept any semblance of responsibility for his actions and the harm he caused.

I believe Senator Monserrate has violated the public’s trust and damaged the integrity of the Senate. While I am willing to listen to any information Senator Monserrate provides, he has failed to respond substantively to the content of our report. In fact, his only response was the threat of a lawsuit. Accordingly, I am prepared to vote for his expulsion from the Senate.

I don't see any movement on the part of the Senate to oust him - talk is cheap.

Hiram's mentor Rep Joe Crowley who anointed Hiram to run for the Senate must step up as leader of the Dem. club house and do the right thing and demand that Hiram step down.
Joe Crowley has been non-existent on this and most local except for his moment on TV last night to obtain an autograph from Pres. Obama. Once again, Joe is pre-occupied with his own personal needs. If only he channeled that energy for which you elected him into office to take care of our vast needs - good luck.

Joe Crowley,Marge Markey, Hiram Monserrate, Gov Patterson, Sen. Shumer are professional politicians who are the cause of grid-lock in office that insures nothing get accomplished on your behalf at the state and Federal levels. They insure thier best interests are taken care of, its a disgrace.

Stavisky states "The assault on Ms. Geraldo was clearly one of domestic violence"

She makes very clear in this statement that the real motive behind these proceedings is to re-try this man on the charges he was found innocent of.

Last I heard, Monserrate was acquitted of all the assault charges, and was only convicted of a single misdemeanor of pulling her forcefully through a lobby while bringing her to a hospital to get help.

So much for our centuries old laws against re-trying cases in which a defendant has been acquitted.

btw, was this man even a member of the Senate on that night?

HE WAS NOT FOUND INNCOENT, HE WAS FOUND "NOT GUILTY"

Last I heard, Monserrate was acquitted of all the assault charges, and was only convicted of a single misdemeanor of pulling her forcefully through a lobby while bringing her to a hospital to get help.

NO HE WAS CONVICTED OF RECKLESS ENDANGERMENT, NOT OF BRINGING HER TO A HOSPITAL.

So much for our centuries old laws against re-trying cases in which a defendant has been acquitted.

HE'S NOT BEING RE-TRIED IN THE SAME COURT AND OF THE SAME CHARGE.

btw, was this man even a member of the Senate on that night?

Our principal of not re-trying people for acts they were acquitted of should protect people from having those charges being re-packaged and tried in a different forum. The State should get one bite at the apple.

state senators are at a higher authority than judges. Haven't you realized yet that they are above the law? they sure have. This just shows more disregard for set laws... like term-limits, and other crooked schemes.

It's not a "principal"; it's a "principle" and it's not a principle, it's a right. And it doesn't apply here. Sorry that the concept of double-jeopardy escpaes you - TROLL!

The concept of double jeopardy does not "escpaes" me, or even escape me.

We have a broadly understood "principle" in this country that we should not re-try people who have been acquitted. That includes re-packaging charges and moving them around to different government forums when the Government loses the case.

We also have "rights", narrowly written double-jeopardy laws giving defendants the right not to be re-tried on the same charges in the same forum.

In this case it is the "principle" that is violated, rather than the right.

It's still wrong, TROLL!

It was Joe Crowleys Christmas party that fueled Monserrates problem. Why isn't Crowley responsible as the host of the party. This is the second time something happened after a party Joe Crowley ran. Seems singing and drinking are his favorite offerings at his partys. Get rid of Joe Crowley!

STATE SENATOR TOBY ANN STAVISKY is a good person. I don't like the unfair attacks on her at all. She has a great humane score. I don't agree with her on this issue but I know that her heart is in the right place. shame on you other trolls.
