Looks like Pinky got his indictment dismissed but is still neck deep in hot water. From the Times:
A State Supreme Court justice threw out the rape indictment against City Councilman Dennis P. Gallagher this morning, finding that prosecutors had unfairly prejudiced members of the grand jury when presenting the case against him, a lawyer for Mr. Gallagher said.
Rape Charge Against Councilman Is Dismissed
The 26-page decision , by Justice Sheri S. Roman, left open the possibility that Queens prosecutors could try to present the case again to a new grand jury — and the Queens district attorney, Richard A. Brown, immediately announced his intention to do so.
“As the court noted in its decision, ‘the testimony and evidence presented to the grand jury was legally sufficient to support each and every one of the counts charged,’” Mr. Brown said in a statement. “Accordingly, the matter will be re-presented to another grand jury before which the defendant can once again, if he be so advised, testify.”
In her decision, Justice Roman indeed concluded that “had the grand jury presentment consisted of the complainant’s testimony alone, the evidence, if accepted as true, would have been sufficient to support all of the charges.”
Councilman Peter Vallone, Jr. is apparently now Pinky's spokesperson (From the Daily News):
Vallone called the married Gallagher's decision to have sex with a woman in his Middle Village office last summer "unwise," but added: "He did not commit the crime of rape...Justice is now done."
"The judge did the right thing in dismissing this indictment, and I would ask that the district attorney not seek to represent it because justice is now done," Vallone added.
Pinky must have some great dirt on Vallone. God save Council District 30.
