Federal lawsuit against Jewish cemetery dismissed

From the Daily News:

One of the oldest Jewish cemeteries in New York City will remain an eyesore and a disgrace to the memories of thousands buried there for the foreseeable future.

A judge has tossed out a lawsuit filed against Bayside Cemetery in Ozone Park charging the operator with failing to maintain the perpetual care of the plots.

Federal Judge Raymond Dearie ruled there is no jurisdiction in federal court for the class-action suit, which was filed more than two years ago.

"As the court has noted from the outset of these proceedings, all agree that Bayside Cemetery's state of decay and disrepair is disheartening and in need of prompt repair," Dearie stated in his decision.

The court papers depict the cemetery - founded in the mid-19th century - as a worthy setting for a horror movie, with human remains exposed in desecrated crypts. The grounds are overgrown with weeds and brush, completely covering many tombstones, rendering paths impassible.

What a shame. No respect for the dead. Bad karma.

It is an absolute disgrace. Also, how can exposed human remains be tolerated? Doesn't the City Health Department have some jurisdiction?

What does that moron mean? If it is a Jewish Cemetary the money to bury came from Jews (not gentiles)and the remains being mishandled are from Jews too.

What does that comment mean??? MORE money?

Always an anti-semite somewhere.

I'm a Gentile; think you don't have something to be ashamed of? Read Kevin Walsh's Forgotten NY Cemeteries section.

Don't flaunt your stupidity. It's unbecoming.

The class action lawsuit has been refiled in the Supreme Court of the State of NY. Go to http://www.baysidecemeterylitigation.com to learn more. Congregation Shaare Zedek misappropriated over $5 million of the cemetery's funds to do things like fix the synagogue's roof. They admitted that in a recent NY Daily News article. I hope the plaintiffs will prevail in state court. Congregation Shaare Zedek has committed great shameful acts of disrespect on the 35,000 dead jewish people in the cemetery.

Would you say the same thing if this was a Catholic or Lutheran Cemetery?

the local jewish politicians always get 90% of the local jewish vote.is it not time for these jewish politicians to dig deep into their own pockets, to repay their voter's ancestors, in these graves ?

do the decent thing immediately !!!! get this sad situation out of the court system. the jewish population is only setting themselves up for negative
criticism.

I hust can't believe the family memebers would allow it to go that far? I mean really, if my family memebers or if I lived in the area I would think I would atleast try to do something. Maybe try to clean it or catch the fuckers who did this? Why has'nt anyone, other than file a lawsuit, done anything?

I'm surprised the jewish community around the city doesn't do something about this.It simply perpetuates the cheap jew bastid stereotype.
