Queens taxpayer gets the runaround

When Sara Jenkins got a notice from state officials saying she had not paid her 2007 taxes, she knew something was wrong.

"I knew I'd paid my tax," says Jenkins. "So I went into my computer, my online banking, and pulled up the check, photocopied the check and sent it in. I thought, 'Okay, they made a mistake.'"

Unfortunately for Jenkins, the State Department of Taxation and Finance did not agree.

"I got the same letter back again saying 'No, you haven't paid,'" she says.

Jenkins called Department of Taxation and Finance and discovered that the City Department of Finance had cashed her check, even though she had made it out and sent it to the state.

Completely confused, Jenkins says the state still held her responsible, and that officials told her, "You actually have to get the money back from the City DOF and you still owe us money and now you owe us penalties and interest for not paying it on time."

To add insult to injury, the state withheld her 2008 refund of $1,500 and put a lien on her bank account and credit.

Yet if I somehow received a check made out to someone else, it would be a felony for me to deposit that check.

Why hasn't the Commissar - the candidate who loves the middle class - stepped into this situation and return Sara Jenkins' money, pay all penalties for her, and fire the Finance Commissioner and then make certain that this felony is never repeated?

That's what an honest manager would do.

A - How did the city get it in the first place if she sent it to the state? sounds like she got her envelopes mixed up.

Explain how her mix-up justifies the felony?

If I received a check made out to someone else due to an envelope mix-up, explaining that mix-up to the judge would not justify my felony theft.

But the Middle Class loving Commissar will steal anybody's property, mistake or deliberate.

If you're a slary grade nine and a city worker and your job is to open up envelopes and make depositis, you don't look at anything, you just do it. Please, taxpayer, your venemous hatred for all things Bloomberg is just so over the top sometimes, you're losing any credibility. btw the way, I'm a Republican who is voting for Thopmson. So don't call me a troll.

This check should never have cleared the bank because the account title and payee were not the same. The bank is responsible to reverse the transaction under basic contract law.

Troll? Who called you a troll? Your own inner truth teller? If, indeed, you do have an inner truth teller, then you cannot be the Commissar himself. You likely are one of his lickspittle lackeys. How do I know? The Commissar is a sociopath. Therefore he has no possibility of having an inner truth teller.

The sociopath Commissar is a compulsive liar and thief. The theft of this woman's check is proof of his thievery. Then he lies all about it rather than just return her money and be done with the matter.

Why do you manufacture insults to your fragile sensitivity?

How do you know the details of who opens and the rules for opening envelops with checks? More manufactured product?

In any event, grade 9 or grade 1000, the check does not belong to the Dept. of Finance. Keeping it for processing and deposit and spending is theft. Probably felony theft. If I kept the check and used the money, it would be felony theft.

In any event, the envelopes are processed by a "lockbox" facility, which is likely a bank, which then processes the checks and charges for the work. Felony theft for keeping a check made to another party.

If the Commissar is not responsible for this deliberate theft, who is? During his campaigning for the illegal third term he is taking credit for all sorts of things he never actually did.

We the voters make the ultimate judgment. If he responsible for what he considers a benefit to all, he's responsible for this theft of this woman's money.

One rule. Applied both ways. Get it troll?

Seriously? Go on a vacation. You're wound much to tight. We agree 90% of the time b/c I am a fiscal conservative. But what happened here is clearly a stupid mix-up. Should this woman get her money back? Of course! But your ranting and raving about felonies makes you look ridiculous! Pick your fights - but don't pick a fight - because then make yourself as low as the mayor. And I am voting for Thompson because your boy, Avella, got tooled like a machine!
