Tribal chief vs. Bloomberg

From NY Magazine:

Mayor Bloomberg, along with Representative Peter King, wrote an August 4, 2008, editorial arguing that cigarette sales on reservations should be taxed—one line insinuated that cigarette-smuggling money might go to terrorists. Chief Wallace is still riled about it. “We got blamed for the MTA deficit! Phenomenal, man. Supporting terrorism. It upsets me because this is our land, whether we occupy it or not. It’s still our land, and we defend our homeland against all enemies, domestic and foreign.”

On August 25 of this year, a federal-court judge in Brooklyn handed down a verdict addressing the Unkechaug’s motion to dismiss. Federal Judge Carol Amon denied the motion and ruled that the state appellate court had misinterpreted the law in question. She ruled that regular tax law indeed applied to the tobacco trade on Indian reservations, as it does everywhere in the state. She issued a temporary injunction banning all further cigarette sales at four stores identified in the city’s suit. Chief Wallace and the Unkechaug appealed. On September 25, the court announced that though the appeal would be heard, the injunction would continue. But that leaves ten other smoke shops in the Poospatuck reservation, and the cars are still backed up around Squaw Lane. “The city will go after every dollar that is owed to city taxpayers,” said Bloomberg in a statement.

Wallace is far from ready to smoke the peace pipe, however. He says it’s the same as it was with whaling in the seventeenth century. “The goal here is not to stop us from selling cigarettes,” Chief Wallace said. “It’s to try and destroy us as a people, because every effort that we made to resolve these things has met with resistance. They don’t want to do it. They want to take it as far as they can to try and kill us.

“They need a scapegoat for not blaming his friends on Wall Street,” said the chief, his tone slowly rising. He began pacing in circles, literally hopping mad. “Who is a convenient scapegoat? The smallest tribe in New York, selling a demonic product—that’s a good scapegoat.”

I can't see how the city has any authority here. After all, Indian Reservations are sovereign nations, and this one is not anywhere near New York City. If anyone should be bringing suit, its the Town of Brookhaven.

The mayor wants all the borough people to stop going to the indians reservations to buy their smokes. He wants us to buy them in the city so he can make money off of us. Dept. of Finance keeps money that was sent as payment to another agency.

Schools are falsifying student grades.

The Commissar is using city employees (on the taxpayers' dime) to advance his campaign events.

A concrete test firm, banned from operation, is back on the job.

And this miserable, imbecilic, tiny mined moron is now trying to control a sovereign nation.

Give him another term and your home and neighborhood is history.

Gambing and cigarettes are far worse for the Natives' reputation than college mascots.

Instread of using his "sovereignty" to promote vice, he should find another way to raise revenue.

Not that I like the "vices" but if you read the original article, the chief mentioned time after time when his tribe did try "cleaner" ways to make a living, only to have the Europeans shut them down.

The entire square area of their reservation is smaller than one of the large estates in Long Island. They have no hunting grounds, no fishing grounds, no cropland, no real estate to rent. How the heck are they supposed to get by? You try it.

Besides, no one forces you to smoke or gamble and those who choose to have to drive to their reservation. They are not coming here.

Anonymous: What's the different between high tax revenue on cigarettes and gambling that is state run? Maybe the city and state should find another way to fund their pet peeves. Last i read tabacco is still legal, but the hate campaign goes on. Why not let a guy make a buck. If anyone should be pissed off at what history has delt them it's the Native American's.

The White Solutrians were here first. Settlers from far across the Great Atlantic Seaway. Originating in Southern France and Northern Spain. Nevertheless, the tribe is a sovereign nation. So, just as your opinion of how France or Germany should be run, you have no say. Your opinion is uninformed.

On the other hand, we, the sovereign people of NYC, voted twice for term limits on office holders.

Is there a lawyer in the house who can answer this?

Have the Poospatuck tried other ways of generating renenue? Maybe a native arts center, or an educational institution?

Do they really want to be known as the "tribe that sold tax-free cancer sticks" because of desperation?

Most of these Cigaretts, coffee, footwear and trinkets are imported from India and Central America.
Tax is already paid in the import process.
Native American resorvation's are exempt period !

Why does this F_ing NYC Mayor and NYC hack judge think they can rule in Suffolk Country as well as re-write the treaty because they are out of money.

*Columbus sent expedition after expedition into the interior. They found no gold fields, but had to fill up the ships returning to Spain with some kind of dividend. Some wonderful revisionist history their George. Tell me about British Australians being the first white people too I imagine you would claim to be on that land. France did not exist then and the white remains your referring to are hotly debated. It was few people also, not whole tribes going back thousands of years in the Dakotas,Arizona, New Mexico, Wisconsin, and New York State.

The fellow who needs other people to do his research is on and about again. How about you check about Indian Sovereignty on your own. Try Google.

If you read history you will learn that the United States has upheld Indian Sovereignty for the last 400 years even while stealing them blind.

In fact, Indians had no lawful right to vote in elections until 1947, presumably because of this Sovereignty.

If Google cannot answer your questions, you might try calling the State Department in Washington or calling the American Indian Museum in lower Manhattan.

But of course, believe what you want to believe, Bloomberg does.

Treaties with the US government.

Treaties with any nation become the law of the land here. Essentially, a treaty is an amendment to the US Constitution.

The treaty cannot be changed now because it is no longer convenient.

The impudent Commissar is impotent (as usual) to alter any part of the treaty.

We all understand that he believes that he is the most sovereign master, but, we also understand that he is a deluded moron.

Do we really need a deluded, demented, savage in control of this city?

Are we so insignificant that he is the best we can do?
