Pan Am shelter resident assaults old man

A resident of the homeless shelter at the former Pan Am hotel was arrested Wednesday for assault after pushing a man outside a school in October, telling police he was trying to protect his family.

David McLean, 39, allegedly pushed the 69-year-old victim on the corner of 52nd and Van Horn streets, near P.S. 102, at 3:15 p.m. on Oct. 28, according to police.

The victim was taken to the hospital for spine fractures and a compression to the spine, according to the criminal complaint.

McLean was arrested and arraigned Nov. 18, and charged with a third-degree felony. A temporary order of protection was issued, and he was released.

He's due back in court Jan. 21.

It's not clear how long he's lived at the Boulevard Family Shelter, inside the former Pan Am Hotel.

Therecis no such charge as third degree felon. There is an assault 3 charge, and that is a misdemeanor. Sounds like the charge was downgraded to keep the numbers down. If you think crime is going down in a city that is down 5000 cops,you're not all there.

If this theory is sound, then the NYPD has not learned anything from the recent settlement they reached with Adrian Schoolcraft.

Which should somewhat verify REBNY's influence on the NYPD to make certain areas desirable and drive up market rates for housing.

It should be second degree assault, according to this:

NY Penal Law § 120.05 states that the assault of an official is a second degree assault where the assault on that official intends to prevent him from performing his lawful duty. The list of officials includes police, emts, firefighters, and train operators. The full list is found at Penal Law § 120.05(3) and (11). ****Assault on a victim younger than 11 or older than 65 may qualify as second degree assault. Causing serious physical injury to such a person will result in more serious charges.****

Samaritan Village really needs to review how they are screening applicants who reside in this shelter. This person is a danger to the homeless families who live in this shelter and the community. There have been other troubling incidents in nearby stores and residence which have not been publicized. DHS and the Mayor needs to close this shelter.

This is called shitcanning.. Every pct has a compstat sergeant. They go over every complaint report to see if they can be downgraded. Robberies downgraded o larcenies,larcenies downgraded to lost property,etc. Goes on every day. The pd keeps telling everyone that crime is down and no one refutes it. There is no way crime is down with 5000 less cops and stop,question,frisk down over 90%. Graffiti and filth everywhere.... But no cops....

Screen them? Puleeze--we can't step on their rights. The sub-class always have their rights in order to step on our rights--the one's footing the bill. No check for criminal record, no check for residency, no check for drug abuse, no check for child abuse, etc., etc., all in our community. And yes, there have been numerous incidents around our neighborhood--all unreported or squashed. Our schools in Elmhurst are the nicest these people's kids have ever attended--and the neighborhood is the most viable. The place is a money-maker for the owners and Samaritan Village--and a tumor in our neighborhood. Has to go.

More millions down the drain and time wasted from settlements resulting from these ill-advised pursuits. And the higher-ups in the NYPD refuse to learn from their mistakes.

The recent rise in crime and what I call the new bad days is the result of blowback from these irresponsible policing policies. And also a combination of overwhelming poverty, the rapidity of homelessness exacerbated by the ludicrous inflated market rate for dwellings.

Unfortunately, thanks to a warped justice system, a lot of recidivist criminals get mixed up with the working poor and displaced families and are free to wreak havoc mainly because the city is so overcrowded now they are hard to trace like rats scurrying in the subway.

The most abominable thing about this is now unscrupulous investors are cashing in on the homeless crisis with bogus charities like Samaritan Village. Again, people's safety and livelihoods are being compromised because a bunch of oligarchs didn't make enough money on hyper-development and the branding of boroughs.

I believe I know who this skell is. He would take his unfortunate kids to ps102 while he would curse and scream. He would try to intimidate women, children and elderly. I confronted him last year, telling him "that's some mouth, your an embarrassment to your kids." He mumbled something about kicking my a- -. I think he might have ended up in a body bag if he tried.
