Toby threatens to have constituent arrested

From American Daughter:

An elected official is threatening to press charges against a constituent who sent her a tea bag. Toby Ann Stavisky, the Democratic New York State Senator from Queens (NY-16th Senate District), has threatened Michael Chimenti, an ordinary guy who lives in her district, writes a lot of letters to the editor of the New York Daily News, and who sent her a tea bag to protest profligate government spending.

Michael Chimenti writes:

NY State Senator Toby Stavisky (16th District) is threatening to press charges against me for sending her a tea bag.

The Albany police said because there was an “unknown” substance in the letter, it becomes a federal offense under the laws passed after 9/11, even though it was clearly a tea bag with a letter in it marked “TEA PARTY”.

Buffalo, New York tea party organizer Allen Coniglio commented via email:

That is a bogus charge and, of course, will be dismissed. It is protected political speech, and only an idiot would construe it as anything but. Please tell Ms. Stavisky to get a life.

These people don’t get that it is just for reasons such as her childish behavior that we the people are so disgusted that we want to throw them all out of office. These people act like thin-skinned thugs and enforcers, using their office to bring the power of the state down on ordinary citizens who, perhaps caught up in the fever of the moment, are doing nothing more than trying to make a political point.

Joe Aaddabbo was had a "cutsie" little fundraiser where he sent tea bags to his prospective donors with a non-invitation to have a cup of tea on him and that way you didn't have to show up at some boring function. I don't know if it worked, because I didn't send any $$$, but this guy should use it as his defense. Toby really is a jerk.

That's nothing. A very nasty politician whose name rhymes with "hitsalot" with a penchant for stabbing women in the eye with either beer bottles or glasses depending on which version you read, has repeatedly attempted to have my downstairs neighbors arrested when they had the nerve to insist on not moving from their rent-controlled apartment of the last 40 years, which by the way is not in rent arrears nor subject to any other reasonable complaint.

The latest incident occurred when the neighbor confronted Verizon Techs who were removing the phone lines of three tenants without authorization of same because the landlord fraudulently assured them that the apartments were empty and under renovation. My neighbor briefly stepped into a common area of the building to examine the severed wires and give the technicians the correct information that all of the lines were active subscriber lines.

For that, police demanded that he, and his companion who was sick in bed and never left the apartment, come into the hall and be questioned.

My neighbor, who confronted the tech briefly and alone, was cited for disorderly group.

The attempted sabotage has been reported to Verizon's internal investigations unit and the police, and a tenant harassment complaint to the State Attorney General's office will follow shortly.

This is the established pattern in Queens. If you have a building that they covet, they will use eminent domain to steal it. If it comes with tenants they will violate the law to put them on the street.

Let's put some of these people on the street come election day.

Last fall, I wrote a letter to Stavisky, and she responded personally.

In her conclusion, she added that her grandfather also came from Latvia, my birthplace. Toby probably read the biography on my website.

She also told me that I live a block outside her district, and I'm better off writing to Malcolm Smith, who represents my block.

In other words, Toby took her time to research me before responding.

I don't consider myself a fan of Stavisky, but I give her credit when it's due.

If Michael Chimenti dislikes Stavisky's policies, he could try running against her.

This ugly creature is a GOVERNMENT official, using her (its) official capacity to punish a citizen for using his GOD Given First Amendment Rights to free speech to obtain redress for his grievances. Any citizen can say to any government official whatever is on his or her mind about any topic that concerns the citizen. Why isn't the media picking up this story? The truth is that the "teabag" protests were well publicized and so Stavisky, unless she keeps her head buried in the sand (which would actually be a good thing), she might have very well expected that someone might voice their displeasure of government by sending a bag to her office. This story needs more attention.

Never heard of the "Tea Tax"?

Not all the contributors to the Constitution were Masons, or wealthy, for that matter. What the Declaration Of Independence said was that "All men are endowed by their CREATOR with inalienable rights." AMONG them, are life, LIBERTY, and the pursuit of happiness. These great, learned men, fully understood that we are all CREATED (by GOD) with rights. And that the correct hierarchy of rule was for now and forever: God, man, then below, government.

The Constitution codifies the acknowledgment that all our rights and freedom are God-given. In fact, no man, no government, no police state power can ever take away our God-given rights. However, ignorance, sloth, fear, can cause man to stop using those rights, permitting the state to grow ever more strong. But, the rights can NEVER be taken by man. I want you to know that you have my full support in this matter.

I wish you all the luck with your harassment campaign against one of your constituents. This is a fine display of courage and leadership that could come only from a Stavisky. I agree that the tea bag was obviously meant as a threat, and I hope you put this terrorist behind bars.

Thank you for making an example of this man and showing that people do not have the right to disagree with their elected representatives. Just because this is America, and because you are paid with his tax dollars and mine, doesn't give him the right to express his opinions without fear of harassment and punishment. Can you believe the arrogance of these people?


Also, I wanted to thank you once again for of your help and Evan's in getting DOB approval for my latest over-sized, out of context housing project. I'm glad you share my view that the zoning laws are really just voluntary guidelines of what can be built, and those of us who really know what's best for the community can do what we want for the right price. My check is in the mail, as promised.

In fact, my admiration for you cannot be properly conveyed in words. And therefore I shall build upon the shores of Whitestone, a housing complex in your likeness. Repulso Towers and Gardens will be so ugly and out of context, that it will remind people of the Stavisky legacy for generations to come.

Well, I just finished reading the Whitestone Times and lo and behold I found the story on page 10 in the "Policer Blotter" section. The article quotes Stavisky ASSistant Jim Dandeneau, "We received an envelope containing a loose powder." Wait a minute! I thought that it was a teabag. Is someone trying to pull the wool over the eyes of the public?

The quote continues, "In accordance with Senate guidelines, the sergeant-at-arms was contacted, who then notified the State Police. The State Police inspected the envelope and returned it, notifying us that it contained loose tea. No further action was taken."

I'm not sure if the paper contacted Mike Chimenti but it did say that he sent the letter in order to make a point about unfair taxes and that there was no malintent. However, Dandeaneau (2 different spellings in the article)had the last word, "It is unfortunate in these times, packages containing unknown substances must be treated seriously."

Well, there ya go. A totally different spin from the Queens Crap blog story. Any comments?
