Assaulted by Briarwood park bums

"These same three gentlemen drink and urinate in public while my wife and I going running with our infant every morning. Today one of them slapped me as I confronted them as they walked past the Hoover children's playground section by Briarwood library. I called the police for the second time and they sounded like they knew who they were. All they have to do is show up at 7 am at the black top ball field across from Archbishop Molloy and they will see them everyday."

Unfortunately NYPD is following to a "T" your mayor's and city council's ruling to decriminalize so many quality of life offenses. They are getting even with the mayor and now we must all suffer. Get rid of DiBlahblah next election!!

Same thing again today. I called the cops; they showed up in 90 minutes and kicked them out of the park. They said there was nothing they could do unless they see a crime. They tell me that it would be an infringement of their civil rights to arrest them for urinating in public. They also said they could only arrest them for drinking in public if they see them. Same goes for the assault on me. Apparently the guy pushing me is neither assault or battery per NY Penal code, according to both the responding officers. Wits end now! The cops say they have their hands tied and can't do anything. I personally disagree. Apparently taking a shit on the playground is a civil right now.

Why would the person 'confront' the homeless people? Unless there was a direct threat to his family, why not let the police handle it. and if the NYPD does not show up, go to the precienct and speak with the commanding officer.

Sounds like this civilian took matters in their own hands since he feels like the owner of Briarwood and the park. Let the police handle it.

Go to the precinct, are you high? I should have to call 911 and that is it. They are drinking, defecating and urinating in public and threatening me!

I certainly don't feel like I am the 'owner' of Briarwood or the park but I have the right to feel safe and not step in human shit on the playground and have to call someone to take care of it. Wait 90 minutes, screw that. I have to get to work. Much faster just to kick them out yourself. I will also reserve my right to defend myself if they put their hands on me. I will never instigate a physical fight but I will stand up to bad folks.

A similar situation happened to me in Corona. I called the police and they took 1 hour 27 minutes to arrive. They knew who the perp was because they are constantly getting calls about the same guy and just got tired of escorting him out of my building.

Uhmmm... yeah you need to go to the press. It is illegal for anyone to lay a finger on you. That is assault. Sounds like the cops that showed up were lying, lazy do-nothings. Take it up with their boss.

Also, start videotaping everything. Nothing happens without proof.

Parks close at midnight or 1am - maybe go see if they are there around that time and call it in. 100% illegal to be in a park after dark. Deprive them of a place to sleep enough times and they'll scurry elsewhere.

Yup, they told me it is not assault and/or battery. They also believe I instigated it, which is true, I did confront the guy because I'm not going to just stand there while someone is taking a piss! However, I never touched the guy before he pushed me.

I am not sure if the cop meant that he had to witness it, in order to make an arrest. However, I was criticized for coming outside to finger the guy. Apparently, there was no crime if they cop did not witness it.

They are never there at night, from my experience. They show up at dusk and drink until they can not stand. Around 6am I go out for a jog, with or without my wife, and they are there half in the tank. I yell at them, they apologize, get up and leave. But then yesterday, I tell them I will call the police and they get offend me, two of them approach me. The older of the three walks away, I believe sincere in his apology. As I am backing up, one of the two pushes me in the shoulder, then proceeds to hit my hand, trying in vain to knock away my phone, as I dial 911.

...but because the cop did not witness it, he tells me it is neither assault or battery or menacing, or gang assault (two/three or more people against one). They also told me video would not help (?).

I do promise that I will continue to defend myself if confronted and will continue to "ask" them kindly to leave everyday. They always do leave when I ask but they just keep on coming back.

Assault 3rd degree = MISD. Charge, physical contact which left persistent pain or a visible injury for the officer to observe. District attorney will not prosecute it unless the victim speaks to a EMT at the scene even if it is to refuse treatment.
harassment = violation charge. No arrest can be made unless the officer does in fact observe the offense being committed.. I.e, slapping, pushing, even punching if the victim has no visible injury or complaint of persistent pain.
Some of you are a little quick to call these two cops lazy all the while you're spewing out inaccuracies and unsound advice.
The facts is, the city council voted to decriminalize this kind of behavior and cops, who are also city residents with families in the boros, are as frustrated with is as anyone else.
Amd if you told 911 you didn't want an ambulance then they do not relay it as an assault and it's clearly not an emergency, so you're gonna have to wait while the car accidents from the morning commute are cleared up first.

I was the complainant and in no way were these cops lazy. They just have their hands tied by the policy outlined above. It's just a little insulting when you are told to just ignore them and wait an hour and half for the police to kick them out while they are turning the park into their own personal bathroom

The same police who will happily manufacture a reason to arrest you if they don't like your face will find any excuse not to arrest people if they're feeling lazy.

Pretty reckless for you to confront this guy if he wasn't targeting you, your loved ones, or your property. Yes, you had the right to point out his bad behavior, but for what purpose? To have a physical altercation that the cops won't do anything about unless one of you is seriously injured? These hooligans could have been carrying knives or worse. And with an infant on site? Jeez, guy, you need to reconsider your risk profile. Better to pester the cops harder (maybe get your neighbors involved) until it's more bothersome for them to ignore you than to obey the permissive directives on QoL misdemeanors.

--Ebay body camera, they are so small the assholes wont see the lens.
They fit in a button hole or between the embroidery of a baseball cap logo. The cops & judge then have the $5 media card as evidence.
A cheap $5 16gig SD card can hold a good 15 minutes of 1080P video.

No baby during confrontation btw but thanks for making the assumption. How can I pester them anymore. I called 4 times today before they showed up. Trust me they feel pestered. You should have heard how inconvenienced they made them seem. They also implied that I should move if I didn't like what was happening in my neighborhood

I live in the neighborhood. Over the last month I've frequented this park w my infant son. I've also seen these same 3 guys falling down drunk as early as 830am. They have not bothered me other than completely laying down on the park benches w the most shade. That said. To the OP this is NYC you better be able to back it up if you're going to confront anybody about anything. To the posters who had an issue about this person caring about thier communit, where do you live??? Why would you want this around yourselves or your family? It's about quality of life. I think we let the NYPD off the hook up easily. This behavior wouldn't be tolerated in other areas of the 107th precinct. Why Briarwood? Also by patronizing the public w the Mayor rhetoric is sad. They still get paid to do a job. Like most of us.

OP here. You are right. I found it much easier today running a little earlier and catching the three Amigos before they settled in the park, politely telling them to turn around. They did and it did not involve depending on the police and waiting around for 90 minutes just to be insulted. It may take a while for them to get the point but it takes a village. 9 out of 10 times they are minding their own business. And I pity them for feeling the need to get that wasted early in the morning. It's sad when you look in their faces all dumbstruck. It's that 10th time when I catch them dumping in the woods or dropping a broken bottle where kids play ball. Problem solved, don't involve the cops, they will just be coddled. Just tell to leave sternly and they will.

Thank you for service Unless you make it uncomfortable for the drunks, they will turn the park into a total absolute dump that no one wants to use. Where are the NYC Parks Dept employees in this mix? Don't they get tired of cleaning up after the vagrants?

It's not serving anyone to allow these guys to make the park into their living room and continue to kill themselves in full view of the public while relieve themselves where anyone can see it. This is clearly a public health hazard.

I was wondering if going to any elected officials or the Community Board would help? Any possibility that turning up at a Precinct Community meeting with the concern might get the cops to do something about the vagrants?

You can make an agency complaint about any NYC agency either online or by calling 311. That pushes it up the food chain.

What if you got the Borough President's office involved?

Isn't there a code of conduct for NYC Parks? Also, where I live there's masses of Parks Dept Police. Where are they in this mix?

BUT,someone trying to slap your phone out your hand is not "slapping you"; which most would interpret as a slap to the face.

Decriminalized doesn't mean they won't get arrested or taken into custody. It means they won't spend a weekend in an over crowded jail simply for taking a piss. Get your facts straight people. Also why would you confront someone when your child is with you? Clearly not very smart

Actually to be clear 1. he pushed me and then tried to slap phone out of hand. Second infant not with me during confrontation. Baby and wife long gone. They don't even know of altercation because she would be fuming and probably calling the mayor lol for me confronting. I was all alone but entire incident was directly in view of the morning Tai Chi crew at manton playground.
