A State Supreme Court Justice required the operators of Forest Hills Stadium to reduce their noise pollution in compliance with the city’s noise code before the start of its outdoor concert season.
The stadium, which is being leased to TieBreaker Productions by the historic West Side Tennis Club until 2034, must now obtain a permit from the NYPD to use sound amplification tools during concerts. The April 10 order also required an independent organization to monitor noise levels emitted from the stadium, which the court will need to approve of.
The order was based on a lawsuit filed against the club by the Forest Hills Gardens Corporation, representing a large number of homeowners living around the stadium. In affidavits submitted in the lawsuit against West Side Tennis Club, residents explained how they believed their quality of life decreased as concerts increased in regularity in recent years.
In addition to the noise that residents say causes their apartments to vibrate, local homeowners also explained that concertgoers trespassing on their properties is a major inconvenience of living near the stadium.
Last month, State Supreme Court Judge Joseph J. Esposito sided with the residents and ordered measures to reduce the volume emitted during concert nights. Prior to the Judge’s order, an expert obtained by FHGC found that the overly debilitating noise that residents complained of was 100 times the legal limit for residential areas set by the city.
“There was no evidence of record that playing of music louder than permitted by law was a significant and necessary part of the stadium’s operation and income,” read Justice Esposito’s order.
The expenses associated with noise monitoring will fall on FHGC, not the stadium. However, the independent agency will provide noise readings after each show for both parties.
While some nearby residents have said that they do not mind the concerts, given that residents closest to the stadium receive free concert tickets and other perks, those who led the lawsuit were content with the judge’s decision.
“Our community was forced to sue the
West Side Tennis Club after the club and its for-profit concert
operator, Tiebreaker, brazenly refused to coordinate with us over the
use and closure of streets, noise levels, concert logistics and TRIPLING
the original number of events they promised when concerts returned to
the stadium ten years ago after a halt of over a decade,” said Forest
Hills Gardens Corporation Board of Directors President Anthony Oprisiu
in a statement.

Gothamites filed 739,527 noise complaints to the 311 hotline in 2022 for everything ranging from barking dogs to helicopters to idling engines and jackhammering.
The UNNECESSARY noise is the major quality of life problem in NYC. Living with the sound of trains, busses and a certain amount of street traffic is one thing but boom cars, backfiring motor bikes and cars and establishments that blast music all night is another. Way past time to start issuing summonses to those who have no respect for the community; that’s why we have a noise code!
Easy solution, move out of NYC!

An unamplified speaking voice at 1 foot is around 50dB
A subway train in a tunnel or concert is around 83dB
The Who and Clash at Shea Stadium in the 1980s was 120dB on the field
10 times 50dB a soft speaking voice would be 500dB, nothing on earth can do that aside an atomic bomb near ground zero and that would burst your lungs.

Most the the garbage hosted at that stadium is not Simon and Garfunkel, Dolly Parton and Willie Nelson. Ace Frehley wouldn't even touch it, does his own shows sells tickets directly to fanbase. At more secure music venues.
The equipment they use at Forest Hills is total slap up shit for "In and Out" as fast as possible with grandfather, father to son handed down union bullshit.
The son in-law former gas station mechanics, bartenders, gamblers and hacks included.
Places like the Garden, Sony Hall and Beacon theater get the most experienced, the rookies are sent to Queens and the Bronx
You also have that 6PM union shutdown dinner curfew, everything stops including soundchecks.
A real FOH experienced techs are locked out (myself included) to work these shows.
This includes even the bands techs, and soundmen who are only allowed to watch and hear. All tips are disregarded, the IA Boss comes out with baseball bat and tells you:
"This is and IA house shut the F_ up, and go F_ yourself"
The IA boss can then shut everything down, total work stop until you leave !
Nasty NASTY pricks !!

I been to Ohio, Id rather kill myself.
All you hear is crickets and moo cows at night, loud rooster in the distance miles away wake you up 4AM, then freight train whistle train wake you up again 6AM, freeze ass of in winter, gotta get in freezing cold (or hot) car drive over 2 miles to do anything.
The 2nd worst is: They feed you defrosted frozen buns, frozen butter, frozen bagels and call Campbells tomato soup with egg noodles a pasta dish.
Freezers and freezers of every dam thing frozen to death....even deer parts!!
