Silver skates but will be retried

Former state Assembly Speaker Sheldon Silver's conviction on fraud, money laundering, and extortion was overturned Thursday.

The judge used a Supreme Court precedent involving former Virginia Governor Bob McDonnell, which more clearly defined the kind of conduct that could be considered corrupt while in office.

"The court talks about certain acts that Silver was shown to have taken that no longer can be considered official acts, such as having a meeting," attorney Joshua Colangelo-Bryan said.

"It is not clear beyond a reasonable doubt that a rational jury would have reached the same conclusion if properly instructed, as is required by the law for the verdict to stand," Jose Cabranes of the Second Circuit Court of Appeals decision said in his decision.

In a statement, acting U.S. Attorney Joon Kim says he will re-try the case.

During the trial, the Mt Sinai doctor who bribed him was given immunity and testified against him.

my timeline may be off, and correct me if I'm wrong, but wasn't the McDonnell ruling made after silver was already convicted?

can you use precedence that occurs AFTER your convicted as grounds to overturn it?

Not much. Chuckie Schumer's boy, thank God President Trump got rid of his sorry ass.

If he - Preet - was real, the whole political class would be in jail by now.
But given the justice system or better yet the lack of it, not so sure about jail.
What a fucking disgrace, one can steal, lie, steal some more, retire and collect pension for all the crimes committed. Great system, is this the democracy we are spreading around the world?

Well, if Silver is appealing, I guess it is considered a "new trial" and a decision reached after his "new trial" would probably be able to be used in that appeal as precedence. Not positive about that statement but it makes sense to be.

Will a New York attorney step up and confirm or deny this thinking? Thanks.

Alas, the whole crooked justice system devalues all honesty itself! And, to answer your question, Anonymous #4, a precedent can not apply to after a conviction has been SO ORDERED, in order to overturn it. It's the corruption and manipulation at the top of the equally crooked-and-corrupt US Supreme Court decision that paved the way for lifetime criminals like Silver to absolve and vacate heinous crimes against humanity for which everyone else continues to pay a soul-crushing price (again and STILL), and the public be damned!

That is why corruption from the top has created an avalanche of endless corruption, graft, cover-ups, kickbacks and payoffs within the vanishing middle and underclasses BECAUSE of the unchecked (and openly practiced) corruption from the top on down. It's also creating violence, lawlessness, vigilantism and open tyranny and anarchy in the streets, where many parts of Queens and other boroughs (including Bloomberg's prized Manhattan that he has now ravaged, tonsured and abandoned, ironically to live in a landmarked section of London), look like a police state ordered curfew after 8:00 p.m. In fact, there is more freedom and privilege at Riker's Island during their OWN nightly orders of lockdown!
