When fences make bad neighbors

Well folks, Gothamist has done it again. The blog that hates anything associated with perceived outer borough "whiteness" recently featured in an article the story of a loving Asian family who bought a home in Broadway-Flushing and wanted to erect a fence "to protect their kids" but was being thwarted by the big bad white homeowners association. Except that is not the case at all. Paul Graziano, urban planner, put together this rebuttal which also serves as a great Queens history lesson and a guide to others with, or seeking to buy, property in a deed restricted neighborhood. I'll also add that the homeowner in the Gothamist article has owned his home for 17 years and therefore must have been well aware of what he could and could not do with it. If not, then shame on him. Fascinating. I didn't know of many active covenants beyond the well known ones mentioned. Wonder if my area of Elm has em? Likely not. The key takeaway is that it's on defendants to prove the unenforceable quality of covenant restrictions. Graziano's is a name I've read before, having accomplished positive things for preservation in NE Queens. Excellent rebuttal!

I live in the area, every year, every home gets a letter about the association asking homeowners to join and explaining that many homes have deed restrictions. There is no way they didn't know.

Just move across Queens Boulevard to the compounds of Cord-Meyer. You could build a small concrete fortress there and it would fit in with the new construction.

In fact, it's one of the most visually compelling examples of bad neighborhood allowances.

this homeowner is disgusting and vile to throw the race card around because he couldn't exert his will.

This line reveals what a piece of excrement this Huang gy isu: "It's beyond the fence," Huang argued. "People need to know the community and America is changing, and some people are struggling with that fact."

Beyond nauseated by the rule of law being stepped on in this country.

I gotta tell you, this is like a day late and a dollar short, response. Way back before the new century flipped from the 20th to the 21st, this area was in a state of radical transition. Not as bad as San Francisco, but getting there. Nice explanation, but good luck. I left the Queens asylum behind in 2010 and now know how right that move was.

That was some history lesson there. I probably have to read it a few more times so it can sink into memory. Maybe Ms. Kim (a twitter follower of mine by the way) should do the same thing.

Although I wonder why Kim (who is also the editor in chief)and Gothamist would delve into a story like this so far from where they usually do the majority of their stories in towns they live in by the subway stops in Brooklyn when they're not in Manhattan.

And that fence is ugly.

THE LAW WAS BROKEN.
No fences allowed! End of story! Your lawyer and title search company knows this. You buy....break law....put up fence....you suffer consequences! No racism. I live within the area too. I didn’t put up a fence and break the law! I could have pulled the race card from the deck too. I didn’t. I’m a good neighbor since 1978!

There are restrictions in condos and co-ops which are agreed to by residents. This is NO DIFFERENT! A covenant has been broken and it doesn’t matter what color race or creed resident broke it. 10-4! Over and out! Take the fence down.

Calling Gothamist a "news outlet" is a stretch. Most commenters are anti-law enforcement, self-loathing white bitches who moved here from the mid-west. They do have decent food reviews.

Nothing to do with civics. Wang and others broke the law. He knew damn well about the deed restrictions. Certainly his lawyer and title search company did. Suffer the consequences for being a law breaker!
