Illegal curb cut & driveway in Elmhurst




"The above pictures are taken from my mother’s neighbor’s home (54-01 80th Street – at the corner of 54th Avenue). He actually created this driveway. He painted the curb yellow, created a concrete ribbon driveway, and has a sign “No Parking.” Totally illegal. He parks commercial vehicles from his fish business in the backyard. The DOB does not respond to complaints filed. It’s not a priority and they will not take additional complaints until the other complaints have been investigated. The complaints were filed in January 2012. So, we get to look at the commercial box trucks decorated with graffiti, along with the exhaust fumes leaking into the rear bedroom windows at 4:30 a.m. Monday-Saturday.

The damage is done.They might get one summons but they will NEVER have to correct this violation.
The Buildings Department can only issue violations, they can't force the homeoowner to comply with the laws.

Agreed - that's an outrage - there is more than one example of folks buying here and suddenly overnight converting a single family to a multi-family home and laughing about it when confronted. "Don't worry I will pay the fine if they fine me!"
So the story here with the truck that backs up into the writer's bedroom window spewing fumes and engine noise is clearly dangerous,illegal (residential area with a commercial vehicle on the illegal driveway pad. Worse yet, vermin, smells and unsanitary storage of fish in the truck and in the house (I gather like most, merchandise is stored in the basement (used as a warehouse) that is a nuisance to all residents surrounding this "BAD NEIGHBOR WHO COULD'T CARE LESS". What is the address of the house I will 311 it and all us reader will too - let go after THE BAD NEIGHBOR!

Super Halal Meat 253-06 Hillside Avenue. This store has had over 80 complaints made to the Buildings Department and 20 open violations. NOT ONE VIOLATION HAS BEEN CORRECTED. This store is operating illegally, lacking permits and in violation of numerous zoning codes and the Buildings Department isn’t able to do anything.
The NYC Buildings Department can only issue summonses and they only do this occasionally. If the violations continue without being corrected the Buildings Department should be writing summonses regularly until the violations get corrected. Why should a homeowner or building owner correct a violation if the Department of Buildings doesn’t follow up on these issues? The laws need to be changed and until our elected officials change the laws, were screwed. It’s only getting worse what are they waiting for.

You see this is where your community board, your community newspaper, and your elected officials fail you - a product of a one party system.

There is absolutely nothing that can be done - yes you are paying taxes, but you are disenfranchised.

Its all going to developers who want to displace you.

It would be really great if Crappy can revisit this theme time and again - and encourage the public to submit examples like this.

If it is not a legal driveway, park in front of it - when he can't get the truck out to go to work - you will have a resolution one way or another.

make a complaint to the DOB that they are using the residential property for commercial uses. make a complaint to the Dept of Health about the fish in the truck!!

Hey, we pay taxes. I don't have time to play city hall.

Call up your councilman. They need to earn their money instead of spending days on the phone trying to get a developer help, renaming street signs and overturning term limits.

Yes, i like that solution. How about stenciling on the sidewalk "THIS IS A LEGAL PARKING SPOT" and parking there?

Oh wait a minute... i'm sure you'll get a ticket from meter maids who will just assume you're parked illegally.

Not true, the neighbors complained about a similar situation on 33rd AV off Parsons (same block as the controversial proposed non-complying Morman site)-- illegal curb cut that fronted the entire house so that they could use the front yard as a multi-car driveway (also with obnoxious "do not park" and "you will be towed" signs -- remodel had clearly turned the house into an illegal multi-family with multiple entrances) and the DOB forced them to re-size it to the original size . . . .

So, don't give up, sometimes you do win!

This goes on all over Queens. I have what used to be 2 backyards facing Austin Stree in Rego Park that were converted into an illegal Parking Lot..mostly used by teachers as PS139 on 63rd Drive. Cars back out backwards and I shocked there aren't more accidents..mostly screeching brakes. I have made calls to everyone and nobody responds. BTW, they even had a rental sign at one time.

the truck,if commercially licensed, is illegal. it probably is only parked at the yard at night hours. the D.O.B.inspector will never respond at these times.

try calling the N.Y.P.D.(911),when the truckers are loading/unloading .report a posssible home robbery on the block ???

the fish peddlers are probably renting the driveway and shed.the land owner is probably not paying taxes on the income.

In Ridgewood there is a house on Decater street between Seneca and Cypress. The homeowner has his front gate on a hinge. He drives his car in front wheels first then swings the rear in with a hydraulic roller jack.
Thats what it takes to park since the early 1980s.
Almost every 2 family house has 2 illegal "hot plate" cash rooms and a bathroom in the basement. Lots of hookers at night too.

Joe, how would you know about the "hot plate" rooms?
should I put money on this? it's an Oriental family w/ six or seven people renting out cubicles in the basement. call it in as an illegal boarding house & that they are running a business in the backyard/house.
how about printing all this out and taping it to their front door? and the gate? or nearby telephone/utility poles?
tell me that the house is owned by an illegal immigrant!

if the cargo is fish, i believe the N.Y.C,Dept. of Health will investigate if the truck is refrigerated ?
D.O.H rid our block of geese that were being raised by a asian owner on our block in Bayside. the honking was annoying.

Get the guy on channel 11 to do the story. Put it on TV and let the world know what a bum & illegal law breaker he is!! I'm so damned sick & tired of these people doing whatever the please and getting away with it. Get your neighbors to mass together and harrass the buildings dept. and all should keep calling 311 and turning this creep in. You pay the same taxes as he does and he gets away with it but turn the tables around and your ass would be sued and large summones what be slapped upon your property. What a shame that, as Americans, we don't have a leg to stand on. Keep fighting. Don't give up. Make his life miserable.

There is no hate here - this is about neighbors being good neighbors by respecting each other not abusing their neighbors by being greedy and infringing upon a normal well being that everyone is entitled to enjoy in life particularly in one's own home!

So if there is a boarding house with 7-12 people as is common on these blocks - call it in. One poster said to print this out and post it - put it on the pole at the bus stop in front of this house!

Stand up everyone - let's get behind this and make changes to right these wrongs that folks do to others. Don't boil call 311 no name is neccessary to leave a complaint!
