A Far Rockaway man wielding a jackhammer while riding a bike at 2 a.m. caught the attention of a couple of 101 Precinct police officers out on patrol last Sunday morning.
Dennis Taylor, 49, of Seagirt Boulevard was riding a bicycle in the vicinity of Foam Place and Smith Place in Far Rockaway when police spotted him with the jackhammer.
The police officers, suspicious that the man held the tool as he rode, approached Taylor and he immediately dropped the jackhammer onto the sidewalk and fled, prompting the officers to pursue him, according to court papers.
He was arrested by the police officers and charged with resisting arrest because, according to court records, he struggled to not be handcuffed by waving his arms and kicking his feet.
He was also charged for riding his bike on the sidewalk. Taylor was arraigned in Queens Criminal Court and released on conditional discharge, meaning that if he stays out of trouble for the next six months, his charges will be dropped.

He was charged with resisting arrest. What he was arrested for? Riding a bike on the sidewalk in the middle of the night? It doesn't appear that he was charged with stealing the jackhammer or threatening the public with it.
If the charges are as written, I would say it was a huge waste of time hauling the guy in.
Especially since the charges are being dropped...
I was wondering what it takes to get arrested for riding a bike on the sidewalk. Now I know. So all you law-breaking bike nuts out there - continue doing what you do - just leave the jack hammers at home.
It's not a crime in NY State to carry a jackhammer while riding a bicycle.

as for the resiting arrest charge, what kind of idiot WANTS to be arrested, to be confined by a lunatic stoned/drunk/unhappy NYC cop?
who in their right mind wouldn't resist arrest?
If the cops spent more time arresting food delivery guys that ride bikes on the sidewalk, and less time arresting jack hammer thieves that ride on the sidewalk, Queens would be a safer place.
And what's with this proliferation of mini-motorbikes that the delivery men are riding? No lights and no license plates. Off course going the wrong way on the streets as well.
