"New York State's Colossal Mistake"

This is the footprint of the Atlantic Yards project (in yellow).

The red outline shows a large piece of property that, according to opponents, contains a lot the state forgot to condemn, which means the entire project is now in really serious jeopardy, if not dead.

And that payment that Bruce Ratner is making to Daniel Goldstein to get him out by Friday is really just a lot of money down the toilet now from Ratner's perspective, because Goldstein really was never the last obstacle. Actually, the last obstacle is the state's own stupidity.

How wonderfully ironic yet completely appropriate is this?

What makes you think this is any less frivolous than the dozen or so lawsuits filed against this project?

Because the state never condemned the property. They can't take something if they haven't gone through the proper legal channels.

So says Matthew Brickerhoff, the plaintiff's lawyer. He and George "Baghdad Bob" Locker, who swore until the eve of the condemnation hearing that Judge Gerges would never grant the state title, always make brash statements when a new lawsuit gets filed. That's their job, after all. And of course the suits always end up getting thrown out.

Needless to say, the ESDC disagrees and will contest the suit. Who's track record is better?

This may not be as good as it sounds. Tax Lot 7501 referred to in the article is not a real Tax Lot designation. It appears the parcel was a condominium 4 digit lot numbers are usually always condo units so lots 1001-1021 are the lots representing the individual Units in the building. Each unit has a certain amount of the common areas (hallways, elevator, manager's office etc.)allocated to it as a percentage of the common element, the City taxes these common elements as a "Dummy lot" 7501 because the Condominium is responsible for the taxes on the common elements, BUT Lot 7501 does not appear on the TAX MAP as a seperate Lot. it is actually owned in various percentages by all the Unit owners

Actually, it's not for "common areas" and there is a lot in ACRIS with this block and lot number.

Mr. Oder believes that the capitalist pig...ahem...Peter Williams is just in this for the $$$.

If that's true - then good for him. Ratner, and especially Prokhorov, have plenty of it. It doesn't change the fact that there's a minuscule chance that this lawsuit actually delays the project.

It really makes no sense then why Ratner gave Goldstein a big payout since he was out of options and the state was the one that needed to reimburse him for his property. Goldstein's Ratner payout was not for his property, it was to get him out sooner.

The fact is that the property in question is also in the arena footprint and is needed by Ratner in order to proceed. I think it's also funny that people who never commented before on this blog all of a sudden had the urge to do so now.

If Ratner had plenty of it he wouldn't need to sell his team to Prokhorov and also wouldn't need the state to use eminent domain to take people's property.
