New York City Councilman Daniel Halloran (R-19th) wants bribery charges against him dismissed.
Halloran filed a motion this week claiming that the laws cited in a federal corruption indictment don’t apply to the allegations against him.
He is under indictment with state Sen. Malcolm Smith (D-Queens) on charges of trying to fix the 2013 New York City mayoral race. He has defended his actions.
Halloran allegedly schemed with Smith to bribe Republican leaders in an effort to win a spot on the city’s mayoral ballot for Smith.
But Halloran said the indictment does not actually charge him with trying to get Smith the nomination.
Rather, he said, it charges that he tried to get GOP permission for Smith to seek the nomination. He said that is a step removed from the nomination and is not prohibited by the bribery statutes.

What a POS this guy is. A real winner in life. Divorces his wife, bangs some 20 year old intern, and now denies the charges. I hope the feds destroy him in court. I wouldnt put it past the Justice system in giving this guy a few years just to make a point to other pols that are probably doing the same crap except a little smarter.
In the final analysis this situation is a very sad one--that we should wind up with a peculiar councilman like Halloran--and that he should be living in a universe of his own creation--surfing the waves of his own mind.
We are at a loss. Let's make sure that the 19th district doesn't get stuck with an even worse councilman. I am speaking of the developers' lobbyist, Paul Vallone.
Do not let the Vallone political venereal disease spread to the northeast and render us impotent--without someone who will adequately represent us, once again!
Vallone is paid by developers to represent them.
How can he honestly claim to represent you?
No matter how he tries to skirt that fact--real estate developer dollars go to the family or family connected law firm. Then it's an easy matter for pappa Pete, and the Vallone boys, to get their share for their piggy banks.

Conversations with the mayor were never recorded. Also, no evidence was shown that there was a quid pro quo between him receiving the endorsement of independence party and the $1 million dollars that was supposed to have gone to the housekeeping account of the Independence party. Here, Halloran brazenly put up a for sale sign for the republican nomination and all of the conversations involving Halloran regarding same were wiretapped. Halloran is not going to skate on these bribery charges.
This POS took monies that were earmarked for autistic children and set it aside for a no show job. All for $20,000 I don't remember Bloomberg (who is also a POS) doing that.

I'm not defending what he is alleged to have done. BUT, how can he take a bribe for something he can't guarantee? Sound more like an illegal lobbying fee than bribe taking.

Dan doesn't have enough roll over info to bargain with the feds for a short stay in the pokey. He'll do some serious jail time.

Of course it is a bribe. If Malcolm Smith could not walk in the front door of the GOP offices and get permission to run on his own, but needed to pay off Halloran to do this - it's a bribe. The crime of bribery doesn't depend upon good delivery of what the bribe is supposed to yield.
Who can walk in the front door and get a nomination? Even a GOPer can't "just get it".
