No I think this is a cellar apartment (>50% below ground). If it were a basement (>50% above ground), it could be legalized. Cellar apartments can't be.
Someone told me about a "wonderful" place like this.. A basement, only $800/month, but you have to do the landlord's yard-work, the stove has only two burners, the door is so narrow you cannot move furniture in or out and there is only one entrance. Also, it is illegal and you can be evicted without warning at any time. What a deal.. Mine did not even include gas or electric.
You can give them all the gift-wrapped inspections they want -- doesn't mean they'll do their job. This situation is totally out of control all over Queens.

Actually, I think since the courts are so in favor of tenants, even though you are living there illegally, if the landlord evicts you, I think you still have rights, in that, he still has to give you notice in advance, as with a non stabalized apartment. I could be wrong though.
Attics, cellars and basements are not to be used as dwelling places in the city of NY. (MDL)
don't worry when you with hold your rent, and the landlord takes you to court they can't get a penny from you and you will be given time to move, up to six months.
why? because the landlord has been stiffing the Dept of taxation, NYS Tax and the IRS on this under the table income.
if you take the landlord to court for repairs or heat and hot water, you could be evicted but the landlord will be forced to remove stove, refrigerator, etc.
But... two weeks after you move, some other poor slob moves in. Immigrant landlords in Queens are great for doing this. and treating their tenants like they are in a third world country. Which is not good at all. I have heard the most horrific stories of harassment, threats of violence and physical attacks on tenants.
solution? deport the immigrant landlords back to their country of origin, get rid of all the illegal immigrants. Then there will be no housing crisis in NYC.
