City Councilman Dennis Gallagher of Queens has been charged with rape and sexual assault in a 10-count indictment that likely contains the most serious criminal charges ever lodged against a member of the municipal legislature. He should resign forthwith. Facing up to 25 years in prison, Gallagher will be consumed by defending himself. He won't be able to represent his constituents effectively, and where he goes, disgrace will follow.
Gallagher's accuser is a 52-year-old woman who met him in a Middle Village tavern and wound up in his office, where, she says, he brutalized her. He says the sex that left the woman bruised and torn was consensual, that he is guilty only of adultery. There, he is wrong. At best, Gallagher lacks mature judgment; at worst, he is a violent sexual predator. Either way, he cannot do the job he was elected to do.
Hours after the indictment Friday, Gallagher, a Republican, voluntarily surrendered his special perks of office, including his $5,000 annual bonus, or lulu, his membership on six committees and his position on the Council's budget negotiating team.
That's how it should be. Get indicted, lose your leadership posts. Now, Democratic Speaker Christine Quinn and Republican Minority Leader Jim Oddo must rewrite the rules so members automatically lose privileges on indictment.

The council's standards and ethics committee is holding a closed-door meeting today to discuss the charges against Mr. Gallagher.
One committee member, Council Member Eric Gioia of Queens, said it would be appropriate to hold off on a council investigation until the Queens district attorney, Richard Brown, completes his own.

A council member of Queens, Tony Avella... said Mr. Gallagher should resign.
"If he really believes he is innocent, then he should be devoting his full time to his defense," he said. "He is not going to be able to devote himself full time to his constituency."

In America, one is considered innocent until proven guilty.
An indictment is simply an accusation.
Looks like that editorial was written by the JPCA executive board and printed in full by the Daily News. Holden's been busy.
Actually, in America, there is something called free speech, which means the Daily News has every right to express their opinion that Gallagher resign. We know Pinky hates the 1st amendment, but that's just too damn bad.

Gallagher has been removed from all committees he sits on. He is basically an empty suit. So he needs to resign for the good of his district.

Pinky was ineffective in the community to begin with because he betrayed the trust of his constituents
by viciously, and spitefully opposing them at every turn (particularly his shameful response regarding the St. Saviour's issue).
In fact, he used his governmental powers to openly and without remorse ABUSE them !
Whatever the outcome the community has already been been RAPED by this arrogant demagogue !
He must, therefore, immediately pack his bags and leave office if he has a shred of conscience left !
He probably can't afford to resign. If he is financially strapped, how will he pay his legal bills?

I think being charged with rape and sexual assault in a TEN count indictment is more than "simply an accusastion".
If he can't afford to resign (those mounting costly legal fees).....
there's always the public defender's office.

Gallagher is just the tip of the iceberg.
Time to flush out the rest of those (yet undiscovered) crooks that make up the city council.
We need to institute a "lemon law" for politicians .

He can pay out of his prison earnings.
Why didn't he think of this before raping his defenseless, innocent grandmother? Why do we need to do all his thinking for him?
He can get money from Bubba for performing services. This is all his problem. When he ran for office did he promise to drink, rape, corrupt and betray? If not, then his constituents didn't get what they were promised.
So, he must resign or be removed.

Gallagher is destroying the reputation of the Queens GOP. The party leadership should challenge him for his un-Republican behavior. If not, the Democrats will.
We know that Maltese and Gallagher are in office because the Democratic bosses agreed to it. Now, the Democrats will make sure that Queens shouldn't even have a token GOP presence

Yes, there was a lot of free speech going on at the Salem Witch Trials.
Free speech is not an absolute right. That's why there are libel laws.
Right, but the Daily News has the right to write an editorial that asks for Gallagher to leave. There is no comparison to the Salem Witch Trials, just as there is no comparison between this and the Duke rape case.
I live in this community and want what is best for it.
Gallagher has to resign. There is no way he can concentrate on his current job, while defending himself of rape, attack and battering of a woman.
In fact, just the simple fact that he was using a taxpayers office for sex should be enough of a reason for him to resign or be thrown out of office.
I was watching the battle between the JPCA and Gallagher and trying to figure out who was right, just like a lot of us.
I now know that the JPCA has the best interests of the community and that Gallagher is a CROOK in every sense of the word.
He sold this community out.
He deserves jail time and every thing else that comes his way, what goes around, comes around.
I agree, Gallagher must go.

I hear that the DA really wants this one and the evidence is overwhelming.
Hot water is mild in terms of what Gallagher is facing the next 12 months and 10 years thereafter (if plea deal), otherwise 25 years.
Legal costs could be as high as $250k.
Docotor bills for the stress can be in the thousands.
He will have to step down from his job and that means no $112k salary.
